ADDITIONAL INFO Most business school classes fail to cover how to fire personnel. Please don't use 'downsizing' as an excuse for sacking problem employees, or creating a culture change in the organization by replacing old personnel with new ones. The worker falsifies records including expense reports. Now you have dramatically cut your risk of lawsuit. This is one of the hardest steps for employers to take in dealing with a bad employee. Today, however, lawsuits for illegal termination are common. Of course the warnings should increase severity with each subsequent occurrence.
This is similar to the problem we've for separating for "bad attitude.". Otherwise, a legal counselor will argue the job elimination was a pretext to the "real" improper reason. You follow this with a written warning, a final written notification, and then dismissal. We believe the best way to handle the circumstance is to react immediately and to confront the person using the policies or rules in place. Other employees, however, are just difficult by nature. Start a formal evidence program and give consistent feedback to the jobholder. Certainly, expect to settle with the jobholder and her legal counselor, but this will generally be cheaper and less disruptive to the department than leaving her job open indefinitely. This ensures the safety for not only the employer and but also the remaining workers remaining in the work area.
