Problems Can Arise When You Separate Workers. Often when you take over a new organization, you'll have at least one problem individual to deal with. Without paperwork or physical substantiation to back reasons for termination, you are opening a window for fired employees to claim improper lay off. Rarely is an employee ever sacked on the spot unless that employee is a threat to the safety of other workforce or involved in criminal activity.

So, have your Human resources manager or employment legal defender review your separation settlement to be sure it complies with state laws. Therefore, if the employee can find any way to sue you for wrongful lay off, he'll do it just to even the score. Therefore, you must watch for a jobholder that has difficulty concentrating or following directions, as this employee may develop into a major problem for you and your company. Remember, the others are watching and if you drop the ball on this one then you will inevitably have to deal with the problem again and possibly from someone else.
